Jefferson County man sues Louisiana driver over crash

A Jefferson County man has filed suit against the Louisiana driver he says crashed into him.

John Brandon Shirley claims he was driving in Jefferson County on May 27, 2008, when he was involved in a collision with Justin Lee Gills.

Because of the accident, Shirley incurred medical costs, experienced physical pain and suffering, sustained mental anguish and lost earnings, according to the complaint filed Feb. 25 in Jefferson County District Court. In addition, he suffered physical impairment, the suit states.

Gills negligently failed to keep a proper lookout, failed to maintain control of his vehicle, drove too fast, failed to apply his brakes, failed to exercise ordinary care, failed to turn his vehicle in an effort to avoid a collision, failed to maintain a clear distance between himself and Gills and drove in disregard for the safety of others, the complaint says.

In his suit, Shirley is seeking a judgment in excess of the minimum jurisdictional limit of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing him.

The case has been assigned to Judge Bob Wortham, 58th District Court.
