Two days after Christmas, Robert O'Connor's vehicle was struck when Kenneth Buck allegedly failed to yield the right of way while making a left turn into a private residence.
O'Connor filed suit against Buck on April 27 in Orange County District Court.
Court papers show that the incident occurred on Dec. 27, 2008.
However, the suit does not state where the incident occurred.
The plaintiff is accusing the defendant of negligently failing to keep a proper lookout and yield the right of way.
He is suing for past and future mental anguish, medical expenses and lost wages, plus all court costs.
The plaintiff is represented by attorney Brian Sutton of the Sutton & Jacobs law firm.
The case has been assigned to Judge Pat Clark, 128th Judicial District.
