Nederland resident William Tarver has filed a petition to perpetuate the testimony of Barney Tarver, a former Union Oil employee who suffers from mesothelioma.
Through Provost Umphrey attorney D'Juana Parks, the petition was filed Jan. 9 in Jefferson County District Court. The anticipated defendants in the pending suit are Union Oil and Chevron.
Court papers show that Barney Tarver's cancer "is expected to progress" and will "ultimately prove fatal."
The petition alleges he developed mesothelioma because he was exposed to asbestos products during his employment with Union Oil.
The petition states that the companies have been notified that a wrongful death suit will be initialized.
Judge Donald Floyd, 172nd District Court, is assigned to the case.
