Henderson County man sues Action Powersports for overtime wages
TYLER - A Henderson County resident has filed a lawsuit against his former employer claiming the company violated federal law by not paying him overtime wages.
Ayrton Stenovitch filed suit against Action Powersports Inc. on March 19 in the Eastern District of Texas, Tyler Division.
Stenovitch worked for the defendant from September 2011 through January 2013. He claims that during one or more weeks of his employment with the defendant, he worked in excess of 40 hours and the defendant failed to pay him one-and-one-half times his regular rate of pay for each overtime hour worked.
The defendant is accused of violating the Fair Labor Standards Act.
The plaintiff is seeking an award of actual and compensatory damages for overtime compensation, liquidated damages, attorney’s fees, interest and court costs.
Stenovitch is represented by Charles L. Scalise of Ross Law Group in Austin. A jury trial is requested.
U.S. District Judge Leonard E. Davis assigned to the case.
