Lawsuit: Roofing services for new League City dental office remain unpaid

GALVESTON - Asserting it is owed nearly $24,000 for roofing services, Seibert Enterprises LLC has filed a lawsuit.

Recent court documents filed April 29 in Galveston County District Court claim League City dentist Brent Patterson and his wife, Brent and Michelle Patterson Family LLP and W.M. Jones Construction Inc. incurred the subject debt.

The plaintiff, doing business as FSR Services, was hired by defendant Jones as a subcontractor on a construction project that was to become a new dental office in League City for Brent E. Patterson.

A written contract between the complainant and Jones states that the former was to lay on a thermal plastic roofing system, specifically on two separate buildings with insulation per the Texas Department of Insurance specifications to the tune of $55,000.

FSR received $25,000 as a partial payment in line with the contract.

The Pattersons fired Jones in September 2012, leaving just the plaintiff on board with the project.

A new general contractor was brought in, and when FSR inquired as to when it could complete its tasks, the complainant was informed that work was done which severely damaged the TPO roofing system already installed, the original petition says.

The complainant then deducted $6,200 and issued a final invoice of $23,800.

The suit adds the plaintiff did not receive documentation that shows it was dismissed from the project, insisting "no additional payment has been made to FSR for the services it provided pursuant to the contract with Jones and for the benefit of the property."

A jury trial is requested.

Attorney Kimberley M. Spurlock of Spurlock & Associates P.C. in Humble is representing the complainant, and Galveston County 212th District Court Judge Susan Criss is presiding over the case.
