Order for non-suit ends vehicle rights lawsuit

GALVESTON - A trial to determine the true ownership of a 2008 Chrysler Model 300 is unnecessary as a Galveston County judge recently issued an order for non-suit into the case.

The order, signed by Galveston County Court-at-Law No. 2 Judge Barbara Roberts on June 28, approves plaintiff Rene Lopez and defendant Amber Lyn Ronning Rodriguez's joint motion for non-suit.

Lopez sued Rodriguez on Sept. 21, 2012, accusing the respondent of failing to sign a special warranty deed to the vehicle.

Their motion, entered June 26, shows Lopez elected to non-suit his claims against Rodriguez while the latter sought the same for her counterclaims against the plaintiff.

"The plaintiff and the defendant further state that the parties have mediated an agreement to settle and compromise their differences in the lawsuit," the two-page document says.

Judge Roberts was supposed to hear arguments from both sides on July 22.

Lopez's suit asserted that the respondent "refused to sign… and continues to refuse" the deed to which she countered could not be enforced as there was no written contract.
