A suit alleging a cemetery wrongfully transferred interment rights has been transferred.
As previously reported, Beverly Redmon filed suit against Live Oak Cemetery on Feb. 15 in Jefferson County District Court, alleging the company trespassed on her burial plot by transferring interment rights on land she purchased.
The case was originally assigned to Judge Gary Sanderson, 6oth District Court.
However, on Feb. 19 Judge Sanderson transferred the case to Judge Bob Wortham, 58th District Court, court papers say.
No reason was stated why the case was transferred.
The lawsuit alleges that on Feb. 19, 2008, Redmon purchased a cemetery plot. In April 2011, she sought to inter her husband.
“At that time, she was informed that someone had already been interred in the space she purchased, and her husband was instead buried in a space in an entirely different section of the cemetery then she had purchased,” the suit states.
The suit further alleges Live Oak Cemetery trespassed on her property by transferring interment rights of her burial spot to a third party.
The company is accused of breaching its contract.
Redmon is seeking an unspecified judgment.
