HOUSTON – A Pearland resident is suing his former employer over allegations it will not let him return to work after a medical leave.

Trey Davis filed a complaint on Dec. 22 in the Houston Division for the Southern District of Texas against AT&T Southwestern Bell Corp., violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that between Sept.15, 2013, and Aug.13, 2014, he was on medical leave after experiencing a brain hemorrhage. The suit states he requested to return to work with restrictions, such as no driving and not lifting more than 75 pounds. He alleges that his job, which he had held for almost 17 years, was sedentary. The plaintiff holds AT&T responsible because the defendant allegedly discriminated his disability and did not allow him to return to work, citing his incapacity to lift heavy objects, which he argues is not an essential function of his position.

The plaintiff seeks the following: compensation for compensatory damages and reinstatement to his position. He is represented by Shelly M. Davis-Smith of Shelly M. Davis-Smith in Houston.
