MARSHALL — An employee is suing a Marshall pottery business, alleging he was fired because of his race.
Artemus McClendon filed a lawsuit June 13 in the Marshall Division of the Eastern District of Texas against Marshall Pottery Inc. alleging racial discrimination, retaliation, and wrongful termination.
According to the complaint, McClendon, a black man who had worked for the defendant since 2002, experienced discrimination from his supervisors. The suit says this discrimination ultimately led to McClendon's termination due to insubordination when he refused to accept a lower position that he was offered by his superior.
The plaintiff alleges Marshall Pottery treated McClendon and similar African-American employees less favorably than their white co-workers. The suit says the defendant also denied promotion to black employees while giving them less salary than other workers.
McClendon seeks a trial by jury, damages of $250,000, lost wages, lost benefits, back pay, interest, all legal fees and any other relief the court deems just. He is represented by attorney Bob Whitehurst of Tyler.
