Busboy alleges employer broke overtime pay regulations

HOUSTON — A Texas man is suing a Magnolia restaurant, alleging failure to pay overtime wages.

Juan Manuel Calderon filed a class action lawsuit, individually and on behalf of all others similarly situated, July 25 in the Houston Division of the Southern District of Texas against Double J Saloon Inc., doing business as El Chaparro Mexican Bar & Grill, alleging violation of the Fair Labor Standards Act.

According to the complaint, Calderon has not receive payment for all the hours he worked since being hired by El Chaparro in October 2011. The suit says he has not been compensated at the rate of one and a half times his regular rate of pay for all hours worked more than 40 in a single week as required by FLSA regulations. 

The plaintiff alleges the defendant routinely edited his time clock entries in order to delete time worked, made improper deductions to his wages, and failed to pay Calderon appropriate minimum and overtime wages for all hours worked.

Calderon seeks a trial by jury, all unpaid wages, an equal amount of liquidated damages, attorney' fees, legal costs and expenses and all relief required by law. He is represented by attorney Robert R. Debes Jr. of Shellist | Lazarz | Slobin LLP in Houston.
