Employee blames Kroger for fall from ladder

GALVESTON — A Texas woman is suing Kroger, alleging the store's negligence led to the plaintiff falling from a ladder and sustaining serious injuries.  

Maria Longoria filed a lawsuit Sept. 7 in Galveston County District Court against Kroger Texas LP, alleging negligence in failing to maintain the common area in a reasonably safe condition.

According to the complaint, on Oct. 13, 2014, Longoria, an employee at Kroger's store on El Camino Real, fell off a ladder 12 feet to the ground. The suit says she struck her head and sustained traumatic brain injury as well as orthopedic injuries.

The lawsuit states Longoria has suffered physical pain, mental anguish, loss of enjoyment of life and medical expenses. The plaintiff alleges Kroger failed to provide protection from falls, failed to properly train and instruct the plaintiff.

Longoria seeks trial by jury, judgment against the defendant to recover all damages, pre- and post judgment interest, costs of court and all other further relief. She is represented by attorneys Paul M. Skrabanek and Michael E. Pierce of Pierce Skrabanek Bruera PLLC in Houston.
