Couple blames driver, employer for husband's injuries in crash

MARSHALL — A Smith County couple is suing an Arkansas company and an employee, alleging negligence in that insufficient measures were taken to prevent injuries.

Lamar McKinney Jr. and Dana McKinney filed a lawsuit Dec. 12 in the Marshall Division of the Eastern District of Texas against Peck-Pantier Inc. of Little Rock, Arkansas, and Beverly Peck, alleging Peck-Pantier negligently entrusted the motor vehicle to Peck.

According to the complaint, on Nov. 11, 2015, Lamar McKinney Jr. was lawfully operating his motor vehicle traveling southbound on U.S. Highway 271. The suit says without warning, a vehicle owned by Peck-Pantier and driven by Peck, negligently changed lanes and struck the plaintiff’s vehicle. 

As a result of the collision, the lawsuit states, McKinney suffered severe, permanent and disabling injuries. The suit says Dana McKinney suffered damages to the husband-wife relationship. 

The plaintiffs allege Peck failed to keep a careful lookout, failed to timely apply the brakes and stop her vehicle and failed to maintain a safe distance.

The McKinneys seeks trial by jury, judgment against the defendants, jointly and severally, for all damages, plus pre- and post-judgment interest, cost of court and all other just relief. They are represented by attorneys Jimmy M. Negem, Joe M. Worthington of Negem & Worthington in Tyler.
