Three carpenters allege former employers failed to pay overtime

GALVESTON — Three carpenters have filed a class action lawsuit against a construction business, alleging violation of workers compensation acts.

Skylar Hamman, Stewart McGee and Steve Rodgers filed a complaint, individually and on behalf of all others similarly situated, filed a complaint March 17 in the Galveston Division of the Southern District of Texas against Western Edge Construction LLC, Mark Tucker and Cindy Tucker, alleging violation of the Fair Labor Standards Act.

According to the complaint, during their employment with the defendants, the plaintiffs regularly worked more than 40 hours per week but did not receive any overtime pay for all the hours they worked in excess of 40 per week. 

The plaintiffs allege the defendants failed to pay overtime wages at one and one-half times their regular rates for all hours worked in excess of 40 per week as required by FLSA.

The plaintiffs seek trial by jury, all unpaid wages under the FLSA, liquidated damages, attorney fees, court costs and expenses, pre- and post-judgment interest and all other relief. They are represented by attorney Andrew S. Golub of Dow Golub Remels & Gilbreath PLLC in Houston.
