Foreman alleges former employer failed to pay overtime

HOUSTON — A former employee has filed a class action lawsuit against an electric business, alleging violation of workers compensation acts in failing to pay overtime.

Faustino Saucedo, individually and on behalf of all others similarly situated, filed a complaint June 23 in the Houston Division of the Southern District of Texas against MSF Electric Inc., alleging failure to comply with the overtime provisions of the Fair Labor Standards Act.

According to the complaint, Saucedo worked from MSF Electric between November 2016 and June 2017 as an electrician and foreman. During his employment, the suit says, Saucedo was paid at the same hourly rate for all hours worked, but was not paid at all for the more than 40 her worked in a week. The plaintiff alleges MSF Electric failed to pay the the required overtime premium for all hours worked in excess of 40 hours per week as required by FLSA..

Saucedo seeks trial by jury, unpaid overtime wages, liquidated damages, attorney fees, court costs and all other just and equitable relief. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of The Buenker Law Firm in Houston.
