Employee accuses school district of discrimination

HOUSTON — A Houston man is suing a school district, alleging age discrimination and wrongful or constructive eviction.

William E. Kay Sr. filed a complaint June 26 in Harris County District Court against the Cy-Fair Independent School District, alleging willful violation of the Texas Labor Code to force him to quit his job due to his age of 80.

According to the complaint, Kay suffered actual damages for the loss of earnings and employment benefits, and mental anguish. The plaintiff alleges the school district subjected him to abusive, hazardous and unhealthy conditions by requiring him to work under a supervisor who subjected him to verbal abuse and intolerable working condition.

Kay seeks trial by jury, damages of at least $300,000, plus interest, attorney fees and costs of court and all other relief. He is represented by attorney Woodrow Esperon of The Law Office of Woodrow Esperon in Kerrville.
