Fluid technicians allege Clements Fluids failed to pay overtime wages

MARSHALL – Fluid technicians have filed a class-action lawsuit against Clements Fluids Inc. over allegations they were not compensated for overtime work.

Doug Laney, Gary McAnally and Chris Morgan filed a complaint individually and on behalf of all others similarly situated on May 16 in the Marshall Division of the Eastern District of Texas against the Clements Fluids Inc., et al. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that Doug Laney, Gary McAnally and Chris Morgan regularly worked more than 40 hours per week without receiving proper overtime compensation. They allege that instead they were paid on a day-rate system. 

The plaintiffs holds Clements Fluids Inc., et al. responsible because the defendants allegedly deliberately failed to pay proper overtime wages at a rate of one-and-one-half times their regular hourly rate for all hours worked in excess of 40 hours in a workweek.

The plaintiffs request a trial by jury and seek an order recognizing this proceeding as a collective action, award for unpaid back wages, liquidated damages, interest, attorneys’ fees, and costs and such other and further relief as may be necessary and appropriate.
