More than 10 Houston apartment complexes face suit alleging it failed to pay workers for overtime

HOUSTON — More than 10 apartment complexes in the Houston area are facing a class action filed by current and former employees who claim they were not paid for overtime.

Jose Aguilar, individually and on behalf of all others similarly situated, filed a complaint March 9 in the U.S. District Court for the Southern District of Texas Houston Division against Candia INc., Falls of Las Villas LLC and others alleging violation of the Fair Labor Standards Act. 

Aguilar worked at the defendants' apartment complexes as a maintenance technician from February 2011 through January 2020. He alleges he and other employees were paid on an hourly basis and regularly worked more than 40 hours per week. Aguilar claims he and others were not paid for overtime but were paid "a portion of their hours" worked each week. He also claims the defendants did not pay employees for travel time between assignments. 

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by Melissa Moore and Curt Hesse of Moore & Associates in Houston.
