Man claims Texas oil, gas industry company failed to pay drivers federal minimum wage, overtime

HOUSTON — An oil and gas industry company, K-3BMI, is facing a suit alleging that it failed to pay its drivers the federal minimum wage and overtime pay.

Gary Skinner, on behalf of himself and all others similarly situated, filed a complaint May 22 in the U.S. District Court for the Southern District of Texas, Houston Division, against K-3 Resources LP, doing business as K-3BMI, alleging violation of the Fair Labor Standards Act. 

Skinner worked for K-3BMI as a driver from October 2012 to November 2019, transporting chemicals and fluids to frac sites throughout Texas. He alleges he was paid an hourly rate, according to the amount of his load, and worked five to seven shifts per week that were longer than 24 hours. Skinner claims he was not paid for overtime, and on some occasions, was not paid the federal minimum wage rate. 

The plaintiffs seek monetary relief, interest and all other just relief. They are represented by Don Forty of Hodges & Foty LLP in Houston.
