Man claims negligence after allegedly falling off curb at local foodmart, pizzeria

GALVESTON — A man is claiming the negligence of a Bolivar foodmart and pizzeria after allegedly falling from a curb and suffering injuries. 

Beja Hopson filed a complaint Oct. 1, in the Galveston County District Court against The Gandhi Corporation alleging negligence. 

Hopson alleges in his complaint that while leaving the Fisherman's Cove Foodmart and Hunt Brother's Pizza in Port Bolivar on Sept. 5, 2020, he fell from "an unsecured and dangerous parking stop/curb." 

Hopson claims he suffered "severe" injuries to his shoulder, neck, arms and other areas and that the "full extent" of his injuries "are still unknown." He alleges the negligence of The Gandhi Corporation for failing to "maintain a safe environment or inspect their property. 

He also alleges The Gandhi Corporation "failed to exercise reasonable and prudent care" by not making the "proper" repairs to the curb and failing to warn of the dangerous condition. 

Hopson claims the defendants also failed to follow and enforce "proper safety procedures" relating to its premises. 

Hopson seeks monetary relief of more than $1 million, interest, trial by jury and all other just relief. He is represented by Sean O'Rourke of The Simon and O'Rourke Law Firm in Webster.
