Jones Day seeks to seal records in litigation against Shearman & Sterling and Johnson Downie

DALLAS - A hearing has been set for next week to seal court records in litigation brought by Jones Day against two law firms and two attorneys.

On Nov. 30, Jones day filed a petition to enforce arbitral subpoenas, naming as defendants Johnson Downie and the law firm of Shearman & Sterling, along with two of its attorneys, Alain Dermarkar and Robert Cardone.

Court records show each defendant was served with arbitration subpoenas under Texas law.

The petition states the defendants have engaged counsel and are unwilling to comply with the subpoenas, arguing that the arbitrator lacks authority to issue subpoenas.

On Dec. 15, Jones Day filed a motion to seal, stating that the arbitration is a confidential proceeding, court records show.

In a brief, Jones Day states that compelling compliance is not only well within the court’s authority, but also furthers Texas’ policy of facilitating arbitration proceedings.

The information detailing the arbitration proceedings in the brief have been blacked out.

The hearing on whether to keep that information hidden from the public has been set for Jan. 7.

Jones Day is represented by attorneys Deborah Sloan and Joseph C. Van Asten.
