Oil tanker seaman files Jones Act suit after slip and fall

GALVESTON — A seaman alleges he suffered serious injuries while working on an oil/chemical tanker and failed to receive proper medical attention. 

Sunday Nwankwo filed a complaint July 24 in Galveston County District Court against Crowley Maritime Corporation and Intrepid Personnel & Provisioning Inc., alleging Jones Act negligence and other claims. 

According to his compliant, Nwankwo was working as a seaman and member of the crew of the M/V Evergreen State, an oil/chemical tanker vessel. He claims that on Sept 14, 2022, the vessel was located near the Port of Houston and was stopped at anchorage while waiting to enter the port. Nwankwo alleges he slipped and fell on a mat on the ship's bridge and struck his shoulder and head on the metal bulkhead. 

He further alleges he was not taken off the ship for medical attention despite his serious injuries until the ship arrived at her berth in Houston four days later. Nwankwo claims he was in the hospital for weeks due to radiculopathy and continues to undergo physical therapy and will likely require surgery. He alleges the defendant's negligence for failing to have a fit anti-fatigue mat on the bridge and for failing to provide a safe palce to work. He also allege the defendants have failed to provide hi with proper maintenance and cure. 

Nwankwo seeks monetary relief of more than $75,000, interest, trial by jury and all other just relief. He is represented by Charles Herd, Jr., and Brandon Francis of The Herd Law Firm PLLC in Houston and Patrick O'Hara of The O'Hara Law Firm PC in Houston.
