Misplaced sign injured woman’s foot, suit against Walmart alleges

HOUSTON - A woman is suing Walmart for injuries she received after she allegedly hit a misplaced sign with her foot. 

Seeking up to $1 million in damages, Malisa Larain Perez filed her suit on March 20 in Harris County District Court. 

According to the lawsuit, on April 12, 2023, Perez was exiting a Houston Walmart when a receipt checker approached. She claims her view was obstructed by the employee and a misplaced sign with a large base, which was difficult to see near the busy exit. 

Perez injured her foot and the impact caused her to fall forward toward her shopping cart, which she grabbed, preventing her from falling to the floor. A Walmart employee indicated that the sign did not belong there and apologized, the suit states. 

The plaintiff is alleging negligence and premises liability.
