In a case filed in the District Court of Harris County, Texas, under the cause number 2024-20031 on March 28, 2024, plaintiff Luz Cepeda Charo is suing defendants Jercoria Morgan and Bridge Greenway Court, LP, also known as Greenway Court Apartments.

The lawsuit stems from an incident that occurred on October 8, 2023. Luz Cepeda Charo was exiting her apartment located on the defendant's premises when the first step of the staircase unexpectedly collapsed causing her to fall through a narrow opening. The violent fall resulted in severe injuries requiring emergency medical treatment and subsequent surgical intervention. The stairs were found to be in a state of disrepair with rusty seams which were allegedly neglected by the defendants.

Charo claims that she was acting as a reasonable person at the time of the incident and that the conditions posed by the rusted step were unreasonably hazardous. She alleges that there were no warnings in place about this danger and accuses the defendants of failing to take precautionary or safety measures to eliminate or reduce injury risk.

The plaintiff is seeking judgment against the defendants for their alleged negligence. She contends that they failed to maintain their premises in a safe manner or provide adequate warning about potentially unsafe conditions. The plaintiff argues that she suffered serious injuries leading to permanent pain and impairment due to this negligence.
