In a compelling legal case that underscores the responsibilities of pet ownership, a Harris County resident has filed a lawsuit against two individuals following a severe dog attack. Troynell Reed initiated the complaint on January 2, 2025, in the District Court of Harris County, Texas, accusing Samuel Nixon and Jennifer Nixon of negligence and seeking significant damages.
The incident at the heart of this lawsuit occurred on January 29, 2024. According to the complaint, Reed was an invitee at the Nixons' residence located at 14306 Kellywood Lane in Houston when he was viciously attacked by their dog. The attack resulted in severe and permanent injuries to Reed. The plaintiff claims that the defendants were aware of their dog's dangerous propensities due to previous incidents where it had either bitten someone or exhibited aggressive behavior. Despite this knowledge, they allegedly failed to take necessary precautions to prevent such an attack.
Reed's petition outlines multiple causes of action against the Nixons. Firstly, he asserts strict liability under Texas's "One Bite Rule," which holds pet owners accountable if they are aware of their animal's propensity for aggression. He also accuses them of negligence for not exercising reasonable care to control their dog or protect visitors from potential harm. The complaint states that these breaches directly led to Reed's injuries.
In terms of relief sought, Reed is demanding monetary compensation exceeding $250,000 but not more than $1 million for various damages incurred due to the attack. These include past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, as well as lost wages and diminished earning capacity. Additionally, he seeks exemplary damages on grounds of gross negligence because the Nixons allegedly ignored prior warnings about their dog's behavior.
