Mark and Diana Sanders have filed a lawsuit against the Mukerji Law Firm, P.C., and its principal attorney, Sambar K. Mukerji, alleging negligence and breach of duty in handling their legal claims. The complaint was lodged in the District Court of Harris County, Texas on February 5, 2025. The plaintiffs claim that due to the defendants' mishandling of their case following a motor vehicle accident in Colorado, they lost the opportunity to pursue significant damages.
The lawsuit traces back to a July 12, 2019 accident involving Mark and Diana Sanders on US Highway 24 near Green Mountain Falls, Colorado. The incident occurred when Shawn Erickson, an employee of SavATree operating a company truck, allegedly swerved into their lane causing a collision with their RV. Erickson tested positive for cannabis post-accident. The Sanders engaged Mukerji Law Firm on August 19, 2019, to represent them against Erickson and SavATree under vicarious liability.
However, according to the plaintiffs, the law firm advised them against using their health insurance for treatment and instead recommended providers with whom they had letters of protection. Furthermore, the defendants filed two federal lawsuits—one in New York and another in Colorado—which were both dismissed due to procedural errors without notifying the Sanders. In addition to these missteps, when Anne Flemming filed a related lawsuit in Colorado state court on May 20, 2021, against Erickson and others including Mark Sanders himself, Mukerji Law Firm failed to assert or preserve the Sanders’ affirmative claims within this ongoing litigation.
The complaint accuses Mukerji Law Firm of failing to communicate adequately with the plaintiffs about critical deadlines and decisions affecting their case. As late as October 2021, Jonathan E. Bleyer from Mukerji Law Firm indicated awareness of ongoing proceedings but did not act before crucial deadlines lapsed on December 2, 2021. Consequently, when attorney Elliot Singer attempted to rectify this by amending pleadings in May 2022 after being contacted by Bleyer for assistance—the court denied such amendments citing missed deadlines.
The Sanders argue that these actions (or lack thereof) by Mukerji Law Firm resulted in them losing valuable legal claims which could have covered medical expenses and other damages from responsible parties like SavATree or Erickson. They are seeking over $1 million in damages along with punitive damages for gross negligence due to what they describe as conscious indifference towards their rights.
