Okla. man claims he was fired over heart condition

An Oklahoma man is suing over claims he was fired due to his heart condition.

Gary Emery filed a lawsuit Dec. 2, 2014, in the Houston Division of the Southern District of Texas against Weatherford International, citing disability discrimination.

According to the complaint, Emery was working for the defendant as an operations supervisor III in Bryan on Feb. 22, 2013, when he underwent a cardiac catheterization procedure, and despite requiring no work accommodations, he was placed on paid leave pending an investigation. Emery says he was informed March 6, 2013, that he would no longer be employed as the operations supervisor III in Bryan, but the company would not discuss the investigation with him. The complaint states he was laid off April 23, 2013, supposedly due to a reduction in the force but he later learned he was initially on the "retain" list. The defendant is accused of disability discrimination.

Emery seeks compensatory and punitive damages, front and back pay, interest and attorney fees. He is represented by attorneys Dustin A. Paschal and Paul W. Simon of Simon Paschal in Dallas.
