Woman died after falling on sidewalk, suit claims

A Collin County woman is suing over claims her mother was fatally injured on uneven sidewalk in Galveston.

Mary Ann Oldner, individually and as representative of the heirs of the estate of Mary Ann Nelson Collier, filed a lawsuit Dec. 11, 2014, in Galveston County District Court against the city of Galveston and Monsignor Kirwin Building Association of Galveston Inc.

According to the complaint, Collier was walking to her car as she left her son's wedding at the Knights of Columbus Hall on Winnie Street in Galveston on June 21, 2014, when she tripped on uneven sidewalk controlled by the defendants and fell, hitting her head. The complaint states Collier lost consciousness and was transferred to the hospital, where she was operated on but never regained consciousness, passing away July 3, 2014. The defendants are accused of negligence, premises defect and wrongful death.

Oldner seeks more than $200,000 in actual and punitive damages. She is represented by attorneys Amber Anderson Mostyn and Molly K. Bowen of Mostyn Law Firm in Houston.
