Man falls off balcony, blames landlord

A Texas man is suing over claims he was injured when he fell off the balcony of a rented apartment.

Jeffrey Nickel filed a lawsuit Dec. 12 in Galveston County District Court against Mosaic SC, citing negligence.

According to the complaint, Nickel was on the second-floor balcony of the apartment he rented from the defendant on FM 518 Road East in League City on Sept. 2, 2014, when the railing broke, causing Nickel to fall to the ground below, lose consciousness and sustain severe injuries to his head, shoulder and knee. The defendant is accused of negligence and gross negligence for failing to maintain the property.

Nickel seeks actual and consequential in damages, interest and costs of court. He is represented by attorneys Kurt B. Arnold and Caj D. Boatright of Arnold and Itkin in Houston.
