Employee sues Morgan Spas for hot tub injury

A Hardin County man moving a hot tub may be in need of a few hours in the spa himself for injuries he claims he sustained on the job.

Matthew Acklin filed a personal injury suit against Morgan Building & Spas Manufacturing Corp. on Aug. 7 in Jefferson County District Court.

According to court papers, on Oct. 18, 2007, Acklin was employed by Morgan. He alleges that he suffered "severe, painful and disabling injuries while moving a floor for a spa deck, lifting and turning at the same time with two other employees."

The suit alleges that Morgan owed a duty to its employee to maintain the premises and surrounding area in a reasonably safe condition. The defendant also was responsible for providing sufficient employees and equipment to do the work as well as proper supervision, the complaint states.

Acklin claims his injuries were proximately caused by the negligence of the defendant.

He is seeking damages, interest and other relief.

March Coffield of the Ferguson Firm is representing the plaintiff.

The case has been assigned to District Judge Milton Shuffield, 136th Court.
