GALVESTON - A visiting judge has
tossed out
a $1 million lawsuit resulting from a two-vehicle accident in La Marque last year.
Senior District Judge Frank Carmona signed an agreed order of dismissal on Sept. 19, disposing Ruby Birch, Frank Revia and Alexandria Underwood's suit against Angel Brothers Enterprise Ltd.
As previously reported, the three individuals filed suit Sept. 24, 2010, in the Galveston County 122nd District Court over a wreck.
According to court documents, on July 17, 2010, a vehicle belonging to Angel Brothers reversed into the plaintiffs' vehicle.
The plaintiffs insist their vehicle was unable to back up because another one was behind it.
Their injuries are moderately severe and debilitating, the original petition says.
The suit does not identify the driver of the Angel Brothers' vehicle, but invokes the writ of respondeat superior.
The defendant filed an original answer earlier this year.
An agreed motion for dismissal was entered on Sept. 15.
In the four-page document, the parties state "that all matters in controversy between them have been fully and finally resolved" thus the plaintiffs "have no desire" to continue pursing legal action against the defendant.
