Truck driver files lawsuit for overtime pay

SHERMAN-A Texas truck driver is suing his former employer to try and recover unpaid overtime compensation.

Alleging violations of the Fair Labor Standards Act, Clinton Roberts filed suit against International Trucking Solutions Inc. and Gregory Hewitt on March 22 in the Sherman division of the Eastern District of Texas.

The plaintiff worked for the defendants from June 2007 through December 2008. He states that his employers failed to pay him one and one-half times his regular rate of pay for each overtime hour worked.

The lawsuit accuses the defendants of willful violation of the Fair Labor Standards Act, which prohibits the denial of overtime compensation for hours worked in excess of forty per workweek.

Roberts is asking the court to award him actual and compensatory damages including the amount of overtime which he was not paid.

The plaintiff is seeking additional damages for interest, court costs, and attorney's fees.

Austin attorney Charles L. Scalise of Ross Law P.C. is representing the plaintiff.

U.S. District Judge Michael H. Schneider is assigned to the case.
