GALVESTON - A Galveston County woman is suing the city of Galveston and some waste companies for more than $125,000 after she fell near the parking lot of the defendants' facilities.
In a lawsuit filed April 1 in Galveston County District Court, Lisa Collins explains that she was delivering phone books to the Galveston sanitation department on April 1, 2008, when she walked on a muddy slope to get to the building - which houses the Allied Waste and Republic Waste Services of Texas offices - and hurt herself.
The suit states that Collins fell on the slope, fracturing her ankle and injuring her shoulder.
The plaintiff insists that the parking lot was in poor shape, and Collins was not aware of it.
"The condition of the parking lot was a premises defect and posed an unreasonable risk of harm that the defendants was fully aware," it says.
"Collins had no actual knowledge of the danger posed by the parking lot."
The defendants are faulted for failing to improve the alleged bad condition of the parking lot and not warning the plaintiff in advance.
Dallas attorneys David M. Hymer and Courtney B. Wright are representing Collins.
The case has been assigned to Galveston County 212th District Court Judge Susan Criss.
