GALVESTON - After falling and hurting herself at a Walgreen's in Dickinson three months ago, a Galveston County woman is suing the nationwide drugstore chain and a local floor maintenance company.
Gina De La Cerda says she was making a purchase at the store on March 8 when she slipped on the floor, which was reportedly under the care of co-defendant Wrights Commercial Floor Care Inc.
Her suit was filed May 25 in Galveston County District Court.
De La Cerda claims a defect on the floor caused her fall.
"Apparently, the floor of the Walgreen store at issue had recent wax build-up that caused the dangerous slip-and-fall condition," the original petition says.
Consequently, the plaintiff seeks damages for physical pain, physical impairment, and mental anguish as well as a jury trial.
Her husband, who is also a plaintiff in the case, seeks compensation for loss of consortium.
Hagood, Neumann & Huckeba Ltd. LLP is representing the plaintiffs.
The case has been assigned to Galveston County 405th District Court Judge Wayne Mallia.
