Suit against pharmaceutical company claims 'roid rage' caused man to kill

MARSHALL-The family of a deceased Texas woman is accusing the manufacturers and sellers of anabolic steroids and human growth hormone of causing "roid rage" in the man responsible for their daughter's death.

Gary Earhart and Kathy Earhart, individually and as representative of the estate of Amanda Jo Earhart-Savell filed suit against Lei Jin, Genescience Pharmaceutical Co., John Does 1-25, and John Doe Corporations 1-25 on June 4 in the Marshall Division of the Eastern District of Texas.

According to the lawsuit, David Jacobs, while using steroids and human growth hormones, shot and killed Amanda Jo Earhart Savell and then killed himself on June 5, 2008.

"It was foreseeable to the Defendants that the unlawful use of their products without the prior FDA approval, supervision of a physician or properly prescribed and administered would lead to a violent change in the conduct of the end uses such as David Jacobs," the court records state.

The Earharts accuse the defendants of being motivated entirely by greed and acting with a conscious indifference to the health and safety of others. The defendants are accused of violating numerous federal and state laws by producing, marketing, and selling the anabolic steroids and human growth hormones.

The plaintiffs are seeking damages for funeral expenses and medical expenses, mental anguish, pain and suffering, loss of companionship and society, loss of inheritance, exemplary damages, loss of economic support, advice and counsel, services, child's services, support, financial contributions and interest and court costs.

Plano attorneys David Schiller and John Exline of The Schiller Firm are representing the plaintiffs. Jury trial requested.

U.S. District Judge T. John Ward is assigned to the case.
