GALVESTON - Tommy Hutson alleges an employee of Dorsett Brothers Concrete Supply Inc. was involved in a car accident with him earlier this year and is suing the business and the driver.
Hutson's suit, which was filed Sept. 1 in Galveston County District Court, insists the plaintiff drove in a safe and prudent manner on Jan. 21 when the collision in question occurred.
Court papers say the unnamed employee made an unsafe lane change in the middle of an intersection and struck the plaintiff's vehicle with great force and violence.
The driver is faulted for driving at a hazardous rate of speed, not promptly and properly applying his brakes, and failing to maintain a single lane.
His employer is accused of assigning him the vehicle as well as hiring and retaining him.
Consequently, Hutson seeks unspecified monetary damages for physical pain and suffering, mental anguish, impairment, and disfigurement.
He is represented by Matthews & Forester.
The case has been assigned to Galveston County 56th District Court Judge Lonnie Cox.
