GALVESTON - A Harris County couple is suing a Dickinson man over the termination of a real property agreement both parties entered earlier this year.
In a lawsuit filed Sept. 7 in Galveston County District Court, plaintiffs John and Monica Preston explain that they signed an earnest money contract with defendant Michael Inglis in May to purchase a lot in the Inglis Special Subdivision in Galveston County.
Under the contract, the Prestons were to pay Inglis whereas the latter agreed to demolish the existing improvements described as a one-story wood frame house and remove the debris from the property on or before closing, which was supposed to occur last month, according to the plaintiffs' complaint.
"The plaintiffs indicated to the defendant that they were ready to close once this requirement is performed," the original petition says.
The plaintiffs argue that they complied with the terms of the contract in every detail, but Inglis failed and refused to follow through with his part in the agreement.
Inglis instead sent the Prestons a letter announcing the contract's termination and demanding the release of the earnest money to him, the suit says.
Consequently, the plaintiffs seek unspecified monetary damages and a judgment awarding them the title to the subject real property from Galveston County 122nd District Court Judge John Ellisor.
