Tyler resident sues after being rear-ended by tractor-trailer

MARSHALL-A Tyler resident has filed a lawsuit for more than $75,000 after she was rear-ended by a tractor-trailer rig.

Nancy Adams filed suit against Ruan Logistics Corp. and Target Corp. on Sept. 17 in the Eastern District of Texas, Marshall Division.

The collision occurred on June 13 as Adams was driving a 2005 GMC Sierra pickup truck on Troup Highway when a tractor/trailer driven by Marvin Lynn Hoadley slammed into the back of her vehicle. Adams argues Lynn failed to maintain an assured clear distance.

Adams states the wreck caused severe and debilitating injuries to her neck, back, shoulders, chest and head.

At the time of the accident, Hoadley was an employee of the defendants and in the scope of his employment. The lawsuit holds Ruan and Target liable for Hoadley's negligent acts pursuant to the theories of respondeat superior and vicarious liability.

The plaintiff is seeking damages for physical pain and mental anguish, torment and suffering, medical expenses, physical impairment, loss of earnings, loss of earning capacity and interest.

Adams is represented by Keith Miller of Law Office of Keith Miller in Tyler and Blake Erskine of Erskine & McMahon in Longview. Jury trial is requested.

U.S. District Judge T. John Ward is assigned to the case.
