GALVESTON - A Galveston County woman has filed suit against Kroger after she slipped and fell at its Friendswood store last year.
Plaintiff Yanhua Kang claims she was shopping at Kroger on Aug. 19, 2009, when she lost her balance while walking over a puddle near the pharmacy.
Kang filed her lawsuit Oct. 22 in Galveston County District Court.
According to the original petition, the puddle originated from a nearby water refill station. It was created by droplets which had been spilled by customers using the station, it adds.
Kang, 59, claims consequently she fell on and hurt her back as well as sprained her wrist. She was immediately taken to Clear Lake Regional Medical Center where she was diagnosed with both a sprained back and thumb.
An MRI taken about two months after the alleged incident showed "straightening of the lumbar lordotic curve due to muscle spasm and a broadbased posterior protrusion subliamentous disc herniation more prominent in the central and paracentral region indenting the thecal sac," the suit says.
Kang seeks unspecified monetary damages and a jury trial.
She is represented by Thomas & Wan LLP.
The case has been assigned to Galveston County 405th District Court Judge Wayne Mallia.
