GALVESTON � James Heath argues that Darlene Broussard caused him to hit another vehicle on a League City street almost two years ago.
Broussard struck the rear of Heath's vehicle on Oct. 14, 2009, while the two motorists were traveling in the 1400 block of W. Main Street and sent the complainant crashing into the vehicle in front of him, a lawsuit filed Jan. 5 in Galveston County Court at Law No. 1 says.
Heath says that he was stopped at a traffic light in the right lane when the alleged collision occurred.
"The force of the collision caused the plaintiff's vehicle to collide with a vehicle directly in front of his vehicle," the original petition says.
"The defendant breached her duty to the plaintiff by recklessly operating her vehicle thus causing the accident."
Broussard is faulted for failing to keep a proper lookout.
Heath claims he suffered injuries to his back and shoulders, but the suit does not explain what happened to the driver he reportedly hit. He consequently seeks unspecified monetary damages and a jury trial.
Gary E. Patterson, P.C. is representing the plaintiff, and Galveston County Court at Law No. 1 Judge John Grady is presiding over the case.
