GALVESTON - The Commission for Lawyer Discipline of the State Bar of Texas has filed suit against Kevin M. Prendergast on behalf of a local woman who claims the Friendswood attorney failed to defend her son over a traffic citation.
Barbara Packales alleges that Prendergast neglected her son's matter despite paying him $100, a lawsuit filed Jan. 25 in Galveston County District Court says.
Prendergast reportedly failed to appear in court for Packales's son, which prompted the city of Houston to issue an arrest warrant for his client. Packales made several attempts to contact the attorney regarding the missed court appearance and subsequent warrant to no avail, the original petition says.
It adds that she ultimately turned to the State Bar of Texas's Client-Attorney Assistance Program, but the defendant failed to respond to the group's correspondence.
The commission is asking Galveston County 122nd District Court Judge John Ellisor to discipline Prendergast through reprimand, suspension or disbarment.
