Shopper sues Wal-Mart after being knocked unconscious by cart

MARSHALL - Wal-Mart is being sued for failing to protect its customers after a shopper was struck by a shopping cart and knocked unconscious.

Norma Hickman filed suit against Wal-Mart Stores Inc. on March 9 in the Eastern District of Texas, Marshall Division.

According to the lawsuit, on Nov. 13, 2011, Hickman was shopping at Wal-Mart in Kilgore when she was struck with a shopping cart causing her to the fall to the floor. Hickman was knocked unconscious and fractured her left elbow.

Wal-Mart is accused of negligence for failing to use ordinary care to protect the safety of its customers, including Hickman.

The plaintiff is seeking damages for medical expenses, permanent disfigurement, physical impairment and pain, suffering and mental anguish, court costs and interest.

Hickman is represented by James A. Holmes of The Law Offices of James Holmes in Henderson and Stephen Woodfin of Law Offices of Stephen Woodfin of Kilgore.

U.S. District Judge T. John Ward is assigned to the case.
