Shopper sues after slipping in spilled milk

An Orange County resident is suing Wal-Mart after she slipped in milk and injured her back.

Bridget Brown, and her husband, Michael, filed suit against Wal-Mart Stores Inc. on Jan. 26 in Orange County District Court. The case was transferred to the Eastern District of Texas, Beaumont Division.

According to court documents, Bridget Brown slipped and fell in milk at the Wal-Mart store in Orange on Dec. 15, 2010. Brown states she suffered severe injuries to her back and hip.

Wal-Mart is accused of allowing the slippery substance to accumulate on the floor, creating a dangerous condition and for failing to warn of the hazard.

The defendant is accused of negligence for failing to inspect and clean the floor, failing to post a warning or use cones, failing to close off the area, failing to institute adequate safety procedures and failing to properly instruct and train employees regarding inspection.

Bridget Brown is seeking damages for physical pain and suffering, mental anguish, medical bills, lost wages, loss of earning capacity, physical impairment, disfigurement, interest and court costs.

Michael Brown is seeking damages for loss of household services and loss of consortium.

The plaintiffs are represented by Sandee L. Hart of Hart Law in Orange. A jury trial is requested.

U.S. District Judge Ron Clark is assigned to the case.
