SHERMAN - A Denton County woman is suing Wal-Mart after she slipped walking into the store and fell, fracturing her wrist.
Deedra Curtis filed suit against Wal-Mart Stores Inc. on Feb. 23, 2011 in Denton County District Court. The defendant removed the case to the Eastern District of Texas, Sherman Division on March 25.
According to court records, on Nov. 2, 2010, Curtis was entering a Wal-Mart store in Lewisville, when she slipped at the entrance of the store and fell. She states at the time of the incident, there was accumulated water and no mats or devices warning of the water.
Curtis claims she injured her wrist in the fall.
The suit alleges the defendant's actions regarding the water created an unsafe condition and created an unreasonable risk of harm.
The defendant is accused of negligence for failing to properly supervise common areas in order to furnish a safe and dry entrance, failing to keep the common areas free from hazards, failing to properly inspect the entrance and failing to maintain the premises in a reasonably safe condition.
The plaintiff is seeking damages for medical expenses, pain, suffering, mental anguish, physical impairment, disfigurement, interest and court costs.
