Suit blames water damage in Galveston condo on neighbors' neglected plumbing leak

GALVESTON � Harris County resident James Kirk Holt is suing Jogeswar and Aruna Challapalli of Austin over alleged neglect of their condominium unit's plumbing system.

Holt's lawsuit claims that broken pipes in the Challapallis' unit at Port Aux Prince Condominiums in Galveston sent water leaking down toward his unit. The plaintiff, however, has not received any compensation, the suit states.

The suit was filed May 6 in Galveston County Court at Law No. 2.

Holt claims he first experienced water damage in late 2010 and filed a claim with his insurer. The damage was fixed although he was not fully covered for the leakage in question because of the deductible in his policy, the suit states.

Holt points out that water from the defendants' place seeped into his unit again at the beginning of this year. The Challapallis failed to properly maintain and repair the plumbing system in their unit which caused the leak to occur, the suit says.

It additionally argues that the defendants failed and refused to pay Holt for his apparent damages.

Consequently, the plaintiff sues for negligence and trespass.

The suit has been assigned to Galveston County Court at Law No. 2 Judge Barbara Roberts.
