GALVESTON - After hurting her left arm at Schlitterbahn Galveston Island Waterpark, Harris County resident Alejandra Gomez seeks legal action.
A lawsuit filed July 27 in Galveston County District Court claims Gomez fractured her left arm while on the Cliffhanger Slide water ride on Sept. 12, 2010.
Gomez claims the failure of the facility's staff "to properly instruct, inform, position and warn the plaintiff prior to placing her in the ride and launching her" caused the incident.
"The plaintiff alleges that the defendants' employees were in the course and scope of their employment at the time of the incident but were not properly trained and supervised to enable a proper and safe performance of their respective job tasks," the original petition says.
According to the suit, the respondent failed to properly supervise the operation of the Cliffhanger Slide, properly maintain the ride, properly train and manage personnel, employ adequate workers, warn of risks and deny the complainant access to said ride.
"The defendants' negligence created a condition on the premise which made it an unreasonable risk of harm to the plaintiff," the suit says.
"The defendants breached the duty of care, proximately causing the injuries sustained by the plaintiff."
Consequently, Gomez seeks unspecified monetary damages and a jury trial.
She is represented by attorney Francisco G. Medina of Houston.
The case has been assigned to Galveston County 10th District Court Judge David Garner.
