Suit claims drunk driver fled from scene of wreck

GALVESTON - A Bayou Vista woman claims she was in a two-vehicle accident with a drunk driver in Texas City last year, recent court documents say.

In a lawsuit filed Oct. 7 in Galveston County Court at Law No. 3, Melissa Henry claims Texas City local Charles Myers was intoxicated when he rear-ended her vehicle on Jan. 31, 2010. Henry is joined by four relatives who were her passengers as co-plaintiffs in the case.

The suit adds the collision was a hit and run as Myers allegedly fled the scene.

According to the original petition, Henry and her family were traveling southbound in the 1500 block of FM 146 when Myers struck their vehicle from behind at a high rate of speed.

The defendant failed to stop and exchange information, but the complainants were able to take his license plate number for authorities, the suit says.

It further explains that Texas City Police found Myers driving erratically in the 3300 block of Loop 197 North, but did not apprehend the motorist until he arrived at his residence.

Myers was subsequently booked on a DWI charge.

The plaintiffs consequently seek unspecified monetary damages.

They are represented by attorney Jeffrey N. Todd of Friendswood.

Galveston County Court at Law No. 3 Judge Christopher Dupuy is presiding over the case.
