Masonry company sues to collect $12,000 debt

GALVESTON - A.M. Masonry Inc. is suing MMNT Corp., Tammy Brundige and Brian Owens over a $12,000 debt.

A lawsuit filed Oct. 24 in Galveston County District Court says the defendants owe the plaintiff $12,502 for the materials supplied or labor performed for them.

According to the suit, MMNT hired Brundige and Owens, doing business as J & B Construction Co., as general contractors to perform improvements on property it owns in Dickinson.

Brundige and Owens entered into a contract with A.M. Masonry as a subcontractor to complete a portion of the improvements, the suit says.

The plaintiff claims it supplied masonry materials and incorporated these materials into the improvements at the property as required under its contract with the respondents, who apparently did not make payment.

It subsequently filed a mechanic and materialman's lien on and against the structure.

"Upon information and belief, the defendants conspired with others to defraud the plaintiff out of the balance due for materials supplied and in accordance with Texas law," the suit says.

"The defendants are liable for payment of all of the sums owned the plaintiff herein."

The Cromeens Law Firm is representing the plaintiff, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
