GALVESTON - Alleging Pioneer Well Services LLC inflicted more than $500,000 in damages to one of its wells, ERG Resources LLC has filed a lawsuit.
Court papers submitted Nov. 22 in Galveston County District Court fault Pioneer for allowing the Loustalot A-8 Well in Galveston County to fill with cement.
According to the original complaint, ERG undertook a project to complete the Loustalot Well and brought Pioneer in to perform completion services in July.
Pioneer claimed that it would perform dependable and quality completion and well servicing to independent operators like ERG, the suit states.
The plaintiff says Pioneer, however, "failed to provide competent, professional and dependable completion services" as requested.
"Pioneer did not exercise a degree of care commensurate with the knowledge and skill required of a ordinarily prudent well services company," the suit asserts.
ERG insists the cement caused property damages and cost overruns in the amount of half a million dollars.
According to the complaint, the plaintiff's efforts to recoup were unsuccessful as Pioneer reportedly "has failed and refuses to..... remedy the damage it caused."
It ultimately accuses the respondent of negligence, negligent misrepresentation and breach of contract.
ERG is represented by Zukowski, Bresenhan & Sinex.
Galveston County 405th District Court Judge Wayne Mallia is presiding over the case.
