Smith County woman files lawsuit after collision with energy company vehicle

MARSHALL - A Smith County woman has filed a personal injury lawsuit after her car was hit by an energy company vehicle.

Brandy Roper, individually and as next friend of two minor children, filed suit against Southwestern Energy Corp. on April 10 in the Eastern District of Texas, Marshall Division.

The incident occurred on June 19, 2010, as Brandy Roper was driving her 2006 Chevrolet Impala in the inside lane of Duval Street in Troup. The two minor children were passengers in the vehicle that was driven by their mother.

As Roper stopped to make a left turn into the park lot of a bank, a Southwestern Energy Corp. vehicle changed lanes and collided with the rear of the Roper vehicle, according to the lawsuit.

The defendant's employee is accused of failing to control his speed, failing to properly apply his brakes, and for failing to keep a proper lookout which caused the vehicle to violently collide with the rear of Roper's vehicle.

The plaintiff is seeking damages for physical pain, mental anguish, physical impairment, lost earnings, lost earning capacity, medical expenses, court costs and interest.

Roper is represented by R.W. Ricky Richards of Richards & Penn LLP in Jacksonville. A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
