Truck driver sues for minimum wage rate, unpaid overtime

SHERMAN - An East Texas truck driver has filed a lawsuit against his former employer to obtain the minimum wage rate for his previous time worked and to obtain unpaid overtime wages.

Clinton Roberts filed suit against Jus-Tex Enterprises Inc. and Dale Robertson on April 20 in the Eastern District of Texas, Sherman Division.

According to the suit, Roberts worked for the defendant as a truck driver from Feb. 10, 2010 ,to Nov. 24, 2010. He states that during his employment he worked in excess of 40 hours per workweek.

The defendants are accused of willfully violating the Fair Labor Standards Act by failing to pay Roberts appropriate overtime wages or the minimum wage for each hour worked.

The plaintiff is asking the court for an award of damages for unpaid minimum wages, liquated damages, attorney's fees, court costs, and interest.

Roberts is represented by Charles L. Scalise of Ross Law P.C. in Austin.

A jury trial is requested.
